Cyclist Recovers £14,000 in Damages After Being Hit by a Careless Driver

Our personal injury specialists were approached by Mr K after he was knocked off his bike by a motorist.

Mr K was aware of Paul Mulderrig’s reputation in seeking justice for personal injury claimants and had been recommended by a few of his friends in the local area.

Mr K was a keen triathlete and would cycle several times per week.

At the time he was training to compete in the Rossendale Triathlon, which we proudly sponsor each year.

On the day of his accident he had just set off from his home to begin a training ride. Shortly after turning onto the main road, he cycled past a petrol station. As he did this a car pulled out and drove directly into him.

This collision caused his expensive carbon bike to be broken into two pieces.

It was suspected that the driver was on their phone and not paying attention to the road, although this could not be proven.

Mr K was rushed to hospital after this accident. He was found to have suffered a fractured ankle and multiple soft tissue injuries as a result of the collision.

Aside from the physical pain caused, Mr K was mostly devastated that his coveted bike had been damaged beyond repair.

After his accident he was house bound for several weeks, meaning that he was unable to work and was not receiving any sick pay as he was self-employed.

He also had to put his strict training schedule on hold, meaning he was unable to compete in the upcoming triathlon he had been training for.

How Mulderrigs Were Able to Help

We agreed to take on the claim against the driver on no win no fee terms.

Shortly after raising the claim, the driver’s insurers admitted liability.

When liability is admitted it is always a good feeling, but especially in this case. It was obvious that the accident was the fault of the driver, but Mr K didn’t feel that he would gain any compensation.

So, when we got the admission of liability so soon, it was very reassuring and meant that Mr K did not have to stress anymore over getting the compensation he deserved.

We obtained expert medical evidence about Mr K’s injuries and a detailed estimate for the replacement of his bike.

With this report we were able to reach a settlement of £14,000, which covered the cost of Mr K’s expensive bike and clothing, as well as his loss of earnings.

Mr K has since made a full recovery and has been able to return to his triathlon activities, with a new bike which he was able to purchase with the money from his settlement.

Paul Mulderrig commented –

“We were all really pleased with the outcome of this case. It’s always good to reach a settlement agreement before court proceedings are necessary, especially in this case where the driver was clearly at fault. I am mostly pleased with the fact that Mr K was able to make a full recovery and get back to doing what he loves, with the help of his settlement.”
