Councils have a legal duty to maintain and repair roads and pavements, but they often deny responsibility because they claim to have a reasonable system for inspecting and repairing defects.
In this case the council initially tried to argue that the broken flag hadn’t been there at the time of their last inspection, so we knocked at the doors of a few nearby residents and, guess what…. they all confirmed that the pavement had been in a dangerous state for ages!!
We brought court proceedings for our client and recently helped her settle her claim for £4,000.
