Solicitors Negligence In Divorce

Mrs Hutchings made a successful claim following a solicitors negligence in divorce proceedings

She was going through a difficult divorce and she was represented by  local solicitors.

Mrs Hutchings’ barrister negotiated an acceptable settlement after some very difficult negotiations.

But her solicitors made a crucial blunder in the paperwork.

The secretary at the solicitors office missed out a couple of crucial words when the draft order was being prepared.

The solicitor didn’t check the draft papers properly and this simple mistake then appeared in the final order.

As a result Mrs Hutchings received thousands of pounds less than she should have got.

Mulderrigs agreed to represent Mrs Hutchings in a claim against the negligent solicitor.

We agreed to act on “no win no fee” terms.

We sent a detailed Letter of Claim to the negligent solicitor.

The Pre-Action Protocol for Professional Negligence Claims encourages both sides settle the case without court proceedings.

So the insurance company for the negligent solicitors admitted there had been a drafting error.

But they said the mistake hadn’t made any difference to the settlement.

So Mrs Hutchings threatened to bring court proceedings against the solicitor.

The insurers then agreed to meet for some negotiations.

Mrs Hutchings then accepted an offer of £25,000 in settlement of her claim.
