The motorists duty to a pedestrian

For as long as there have been vehicles on the roads there have been accidents in which pedestrians have been injured. Way back in 1832 (Boss -v- Litton) the court decided that "....all persons, paralytic as well as others, have a right to walk on the road and are entitled to the exercise of reasonable care on the part of persons driving carriages upon it!"

The courts always bear in mind the fact that pedestrians travel slowly and pose very little risk to anyone, whereas vehicles travel very fast and pose a very serious risk to pedestrians.

Our recent cases

Miss Walters  was walking on the pavement in Greater Manchester when  some girders fell from the back of a lorry which was being loaded as she walked by. She suffered a nasty injury to her ankle and foot and we helped her to recover compensation of over £26,000.00.

Drunken Pedestrians who got compensation

Mr Wilkins from Derbyshire suffered a serious head injury when he was hit by a car as he attempted to cross the road on the way home from a New Year's party in the early hours of the morning.
