Compensation for Medical Negligence

Our health service professionals usually deliver a high standard of care but just occasionally they get things badly wrong.

Mistakes in medical treatment can cause great distress, and can often result in serious injury to the patient and, sometimes, even death.

To make a  successful claimfor medical negligence compensation you will need  to  prove that the standard of care  you received fell below  that of a reasonably competent practitioner in the relevant area of medicine, and alsothat the substandard care has directly resulted in a physical or mental injury.

Even if your case seems straightforward, the doctor/dentist or health authority are likely to contest any claim that you make, and Medical Negligence is a very specialist area of the law, so you should contact a solicitor who is an experienced expert in these types of claims.

Some of our recent medical negligence compensation cases

A husband & wife recover compensation for botched dental work. - Mr & Mrs Crilly from Lancashire had to find a new NHS dentist when their usual dentist retired, and ended up being treated by a dentist in Bury.

Mrs Crilly had work done on three fillings and four crowns, but after the treatment food kept getting stuck behind both the fillings and the crowns. Her teeth were left feeling very rough on the inside and also appeared to be too long as they kept catching on her lip, which left her feeling very self conscious. Fortunately, she eventually had all the work corrected by a competent NHS dentist. The insurers for the dentist who had caused the problems denied any liability and we issued court proceedings before helping her recover £3,000.00 for the pain and distress she had suffered.

Mr Crilly had a similar experience at the hands of the same dentist. Fortunately, he managed to have all the substandard work corrected by a competent NHS dentist and we then helped him recover £3,700.00 for the pain and distress he had suffered.

£10,000.00 compensation after an error during laser eye surgery -  Mrs Jenas underwent laser eye surgery in South Wales. The initial surgery was successful but she was also advised to undergo lens exchange surgery, which wasn't done properly and left her with blurred vision for several months.

Fortunately, our client had the damage corrected and she made a full recovery, but she had to put up with blurred vision for several months.

We took on the case against the insurers for the surgeon, and our expert said that the lens exchange surgery probably wasn't necessary, and even if it had been necessary the wrong lenses had been used.

The surgeon denied any liability for the damage to our client's eye, but as we approached a trial of the claim the insurers agreed to pay our client £10,000.00 in compensation.

£14,000.00 compensation after another eye surgery error - Mrs Carlton is an elderly lady who needed cataract surgery on both eyes. The first operation went well, but there was a problem when the second operation was carried out a couple of weeks later. The new lens broke and as the surgeon had not taken the necessary precautions this damaged the cornea. Our client was left with some double vision and a drooping eyelid.

The insurers for the surgeon denied any responsibility for the damage to our client's eye, so we brought court proceedings on her behalf and helped her to recover £14,000.00 in compensation.

(The names of our clients have been changed).
